Skilled Cherry Hill, NJ Debt Lawyer Explains the Role of the Bankruptcy Trustee

The process of filing for bankruptcy involves more than one person. It involves you, your bankruptcy attorney and the bankruptcy trustee. It is important to learn about every person’s role in the bankruptcy process. I can help make certain you have the information you need.

I am attorney Joel R. Spivack, and my practice is entirely dedicated to handling matters involving bankruptcy law. With more than 30 years of experience in consumer bankruptcy, I have helped countless individuals find debt relief. I understand the challenging, unique and overwhelming stresses that come with financial debt. I am here to help you get back on your feet.

Talk to Joel R. Spivack about What a Trustee Does in Chapter 7 Bankruptcy and Chapter 13 Bankruptcy

The bankruptcy trustee’s role is to verify and maximize the amount that the debtor (you) is paying to the creditor. Trustees are very much involved in the bankruptcy process and are in charge of keeping the bankruptcy process moving along as quickly as possible.

In a Chapter 7 bankruptcy, the trustee’s duties are to maximize the bankruptcy for creditors. The trustee will sell nonexempt property to pay creditors and verify that all the information in the bankruptcy petition is correct.

It is important to know that in most cases you will not lose any of your property because it will be considered exempt. Do not let the common misconception that “you will lose everything you own” fool you.

In a Chapter 13 bankruptcy, the trustee will verify information, make sure that payments are made to the repayment plan and ensure that the plan is followed accordingly.

The benefit of working with my law firm is that you have an experienced bankruptcy lawyer advocating for your interests at all times. I take time to explain every step of the bankruptcy process, including my role as your attorney, your role as the person filing (debtor) and the bankruptcy trustee’s role in the bankruptcy process. If you have questions or concerns, they will be answered promptly.
